CASH PAYMENT

In the case of cash payment and VAT not being clearly stated, this constitutes a sale with a fictitious input tax deduction! See the legal basis here. This equates to a discount of 8,1% on the purchase price!

Caution: Some groups of dealers (especially from Aargau and Bern) prefer cash payments in order to illegally claim input tax via fake seller addresses.

DEPOSITS

Beware of deposits: Some dealers require a small deposit to reserve the vehicle. They then find a suitable buyer and collect their commission in cash – often in addition to social security contributions. If, contrary to expectations, you don't find a buyer, don't pick up the truck and wait for the seller. If they then sell the truck to someone else, you will naturally want your deposit back.

Correct procedure: Either never accept down payments – in case of doubt, no purchase agreement is formed (at least not a legally binding written one). The other solution: Put the buyer in default and set a deadline of 10 days. Simultaneously collect a parking fee of CHF 50-100 per day. Then resell the vehicle.

VEHICLE HANDOVER

Certain fraudsters specialize in buying multiple vehicles at attractive prices, only to pick up a portion. Their modus operandi: they immediately collect the cheaper vehicles and leave the more expensive ones behind. BEWARE OF IRAQI REPRESENTATIVES

Certain individuals claim to be acting on behalf of a foreign dealer. They pretend to be representatives working here on behalf of someone else. This practice is illegal and indicates undeclared work. In Switzerland, every foreign worker must be covered by social security. Especially if the person also speaks perfect Swiss German and drives a car with local license plates, this is a sure sign of tax and social security fraud. As a seller, you are generally free to do business with such individuals. However, the question arises as to how these people suddenly appear with large amounts of cash. (Money laundering?)

PREFERENTIAL ORIGIN & EUR.1

Preferential origin refers to goods that can be imported duty-free or at reduced rates under preferential agreements between the EU and other countries or groups of countries. These agreements establish specific rules of origin that must be met for the goods to benefit from the tariff concessions.

EVIDENCE OF PREFERENTIAL ORIGIN:

In order to benefit from customs advantages, certain preferential documents must be presented, such as:

  • Movement certificate A.TR (only for trade with Turkey) 
  • Movement certificate EUR.1 or EUR-MED
  • Declaration of origin or declaration of origin EUR-MED
  • Supplier declaration
  • Certificate of Origin Form A (for imports from developing countries)


The EUR.1 form is a proof of origin that confirms the origin of exported goods from the European Union (EU). It allows the buyer in the destination country to benefit from customs benefits. The form plays an important role in the application of bilateral trade agreements and facilitates the international movement of goods.

ATTENTION! Volvo Trucks, Renault Trucks, and many VW vans only have limited proof of origin or are unable to provide it at all. Never authorize a stranger to complete a EUR1 form on your behalf. If it turns out that the proof cannot be provided, you may be held liable for customs duties.

T1 – DOCUMENTS

The T1 document is used in the international movement of goods within the European Union (EU). It serves as proof that goods are under customs supervision while they are being transported from one EU country to another.

You need a T1 document for proper customs clearance in the European Union. Various shipping companies issue this document against a deposit of 8.1% of the value of the goods. After successfully deleting the T1 document when leaving the European Union or reaching the destination country, the full deposit will be refunded.

An incorrectly declared export will result in you having to pay the statutory VAT in Switzerland. In case of doubt, Motortrade can demand statutory VAT amounting to 8.1% of the value of the goods as a deposit. This will be refunded after receipt of the final assessment decision from the Federal Customs Administration.

TRUCK EXPORT / TRANSFER SIGNS

For the export of vehicles, export plates are issued at the Zurich and Winterthur road traffic offices.

It is not possible to obtain it from the testing centers in Regensdorf, Hinwil, Bülach or Bassersdorf.

The owner must submit the following documents:

  • application form
  • Original vehicle registration document
  • Original driver's license
  • Passport, identity card or residence permit in the original
  • Cash, Maestro or credit card

The transfer labels do not have to be returned after their validity has expired.

Intra-community delivery (IGL)

Intra-community deliveries are tax-free deliveries of goods between companies in different EU member states.

Failure to follow the procedure will result in the payment of German tax. Trucktrade Germany GmbH can request a deposit of 19% of the value of the goods, which will be refunded upon receipt of confirmation of arrival.

Confirmation of arrival

The Certificate of Entry is a document confirming the successful transport of goods to the country of destination and is important proof of the tax recognition of the intra-Community delivery. A missing Certificate of Entry will result in the denial of the intra-Community delivery and will result in VAT being due.
